Common Sense Business Regulation Policy

It is the policy of the Ohio Department of Aging (ODA) that the agency will adhere to Executive Order 2008-04S. Executive Order 2008-04S, "Implementing Common Sense Business Regulation," Paragraph 5(f), provides as follows:

"Agencies should when appropriate waive penalties for first-time or isolated paperwork procedural regulatory non-compliance. Each cabinet agency, board and commission shall prepare and publish on its website, a policy describing the circumstances in which such waivers shall be granted."

It is the policy of ODA to waive penalties for all first-time or isolated paperwork or procedural regulatory noncompliance whenever appropriate. ODA believes that the waiver of penalties for an individual's failure to comply with the Department's regulations is appropriate when:

The violation of the Department's regulations is a minor violation;
The waiver would not result in the forgiveness of a debt owed to the state or federal government;
The waiver would not result in a misuse of state or federal funds;
The regulation that was violated and the penalty it assesses, are not a regulation and penalty required by federal law; and
Waiver of the penalty would not pose any actual or potential harm to public health or safety.
